We have a specialised construction and procurement team advising and assisting the building and construction industry in all aspects of building and construction projects.
The construction and procurement team involves members from all of DANDERS & MORE’s special teams. We handle all stages of a building and construction project; from the preliminary determination of the procurement strategy and construction type, the preparation of procurement material and to the stage of execution. We also assist during the continued operation until the five-year inspection has been held.
The members of the team work with construction law, real estate, litigation, procurement and competition law on a daily basis. We are specialists with many years of experience in advising public and private entrepreneurs, technical advisors and contractors, and we have years of experience from some of Denmark’s largest law firms and building and construction groups.
We believe that the parties generally should spent their time and resources on the construction project and not in court or before the arbitration tribunal.
Therefore, we generally believe that there are workable and constructive solutions to the complex challenges faced daily in the building and construction industry. Such challenges might be in the shape of delays, which have financial consequences for the parties involved, or it might be in the shape of additional claims due to extra work or in connection with withdrawal from the provided guarantee, cases relating to section 46, defects in execution or planning, or expert opinions. Finally, we attend settlement negotiations and handle any court cases or arbitration proceedings, if the parties fail to reach a solution.
Should arbitration proceedings become inevitable or necessary because the parties fail to settle their dispute, we have a great deal of experience in conducting cases before the Danish Building and Construction Arbitration Board. Primarily, we assist in relation to the strategy for the procedure, settlement negotiations, arbitration proceedings, expert opinion, preservation of evidence and progress status reports, expert decisions pursuant to AB 92/ABT 93, section 46 (General Conditions for turnkey contracts), informal assessment and mediation.
